No financial penalty or temporary suppression of “Touche pas à mon poste”. Seized by many viewers, the Superior council of audio-visual (CSA) returned a rather lenient decision concerning the last Hanouna affair. Not that of a homophobic or sexist slippage this time, but of an underground advertisement for the ghost company Skyline Airways, appeared several times on the air in September 2019, both in “TPMP” and in “the Great Darka”.
After several months of studying the case, the independent rapporteur who conducted the investigation sent his conclusions to the wise. The latter therefore opted for a formal notice from the company C8 to encourage it to respect the obligations imposed on it in terms of advertising and sponsorship. When contacted, the channel declined to comment.
“Warm thanks”
In its defense, the direction had specified before the council that it was about a sponsorship identified by the mention “With the participation of Skyline Airways” registered in the credits at the end of the emissions. Not sufficient for the CSA, for whom “this very little visible mention and kept on the air for a short time cannot be regarded as having been clearly identified” within the meaning of the law.
The PAF regulator drives the point home, recalling that the company Skyline Airways “has been the subject of repeated quotes […] accompanied by warm thanks “and” close-ups “as well as” the mention of the website “of the alleged airline, which constitutes” an advertising promotion “. A C8 to identify, in the future, “clearly the sponsorships as such and refraining from any advertising promotion by the sponsor when delivering his products or services as prizes”.
“TPMP” suspended?
Otherwise, Cyril Hanouna’s chain would expose itself to real sanctions listed by the CSA. Among these, the suspension, for one month at most, of the program or of several advertising sequences, as well as a “financial penalty” up to a maximum of 3% of C8’s turnover. In July 2017, the Canal + group channel was sentenced to a record fine of 3 million euros following the hoax deemed homophobic by Cyril Hanouna. Fine confirmed by the Council of State last September.
